1. BINDING AGREEMENT AND PLATFORM USAGE

This document constitutes a legally binding contract between you (the "User" or "Customer") and Dakiheaven ("we", "us", or "our"). These Terms govern your use of https://dakiheaven.com/ (the "Platform") and all associated purchases.

By browsing, accessing, or executing a transaction on this Platform, you explicitly acknowledge that you have read, comprehended, and agreed to be bound by these Terms. IF YOU REJECT ANY PORTION OF THESE TERMS, YOU MUST IMMEDIATELY CEASE USE OF THE PLATFORM.

2. AGE VERIFICATION AND COMPLIANCE

Certain sections of our catalog feature age-restricted adult content. By interacting with our digital age-verification overlay and accessing these restricted materials, you legally warrant that you are a minimum of 18 years old, or the recognized age of legal majority in your current jurisdiction. Falsifying your age to bypass our security measures is a direct violation of these Terms and will result in an immediate ban and potential order cancellation without notice.

3. HANDMADE PRODUCTION TOLERANCES

Because our physical merchandise requires manual manufacturing and stuffing processes, exact uniformity cannot be guaranteed. You acknowledge and accept that final textile measurements may deviate by 1 to 3 centimeters, and total item weight may fluctuate by 10 to 100 grams. These minor physical tolerances are an inherent part of our production method. They do not classify the item as "defective," "damaged," or "not as described" under any buyer protection policy.

4. FINANCIAL TRANSACTIONS, TAXES, AND CHARGEBACKS

We process secure payments via Visa, Mastercard, American Express, and PayPal. By submitting payment details, you authorize us to charge the designated method for the total order value.

• Taxes and Import Duties: Dakiheaven ships internationally and handles applicable Value-Added Tax (VAT) directly to ensure a seamless delivery experience. We utilize Delivered Duty Paid (DDP) methods and other optimized logistics so that our customers do not face unexpected tax burdens upon delivery. In the rare event that you are charged additional customs fees or import duties upon delivery, please contact our support team at support@dakiheaven.com. Upon providing a valid, official customs invoice or receipt directly corresponding to your Dakiheaven order, we will refund the full fee amount shown on the receipt.
• Fraudulent Chargebacks: We maintain a zero-tolerance policy for friendly fraud. Initiating a bad-faith chargeback or payment dispute for an order that was successfully delivered or falls outside our authorized return policy is a breach of contract. We aggressively contest all unauthorized chargebacks using your timestamped IP data, checkout agreements, and delivery logs.

5. STRICT HYGIENE AND RETURN PROTOCOL

We provide a 31-day return window for eligible standard catalog items, subject to the following non-negotiable conditions:

• Intimate Goods Hygiene Lock: Dakimakura covers and inserts are classified as intimate bedding. To ensure health and safety, returns are strictly prohibited if the original transparent packaging has been opened or the hygiene seal is broken. Unsealed merchandise is ineligible for a refund under any circumstances, barring verified manufacturing defects.
• Bespoke and Custom Orders: Items manufactured using your personally uploaded artwork or distinct customizations are inherently non-returnable. Because these goods are tailored to your exact specifications, they are legally exempt from standard consumer withdrawal rights.
• Return Logistics: If returning an eligible, fully sealed item, you must shoulder the direct cost of return freight to our Netherlands facility. Refunds are exclusively disbursed to the original payment method within 10 business days following our successful inspection of the returned parcel.

6. RESTRICTED CONDUCT

While utilizing Dakiheaven, you are expressly prohibited from:

• Deploying malicious scripts, bots, or automated software against our infrastructure.
• Attempting to manipulate our multi-lingual routing or localized pricing algorithms.
• Harassing customer support personnel or submitting fabricated claims of product damage.
• Utilizing the Platform for unauthorized resale arbitrage or unauthorized commercial distribution.

7. JURISDICTION AND DISPUTE RESOLUTION

These Terms, and any external disputes arising from your relationship with Dakiheaven, shall be governed exclusively by the laws of the Netherlands, superseding any conflict of law principles. You irrevocably agree to submit to the exclusive jurisdiction of the Dutch courts for the resolution of any legal proceedings.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAKIHEAVEN SHALL NOT BE HELD LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR ACCESS TO OR INABILITY TO ACCESS THE PLATFORM OR MERCHANDISE.
