1. About the designs on this site

Dakiheaven prints and sells dakimakura covers. Many of the designs in our catalogue are fan art: artwork made by illustrators who drew characters from anime, manga, games and other published works.

We do not own those characters, and we do not claim to. The characters, names, logos and trademarks in these designs belong to their respective creators, studios and publishers. Dakiheaven is not affiliated with, licensed by, sponsored by or endorsed by any of them.

2. Reporting a design

If you hold rights in a work and believe something we sell or display uses it without permission, tell us and we will look at it. You do not need a lawyer to write to us, and you do not need to threaten us with one.

Email support@dakiheaven.com with IP notice in the subject line, and include:

  • Your name, and whether you are the creator, the rights holder, or someone authorised to act for them.
  • A description of the work you hold rights in, with a link to it where one exists.
  • The full web address of every page on dakiheaven.com you are asking us to act on. A product link lets us act the same day; a description of the artwork usually does not.
  • An email address we can reply to.
  • A statement that you believe in good faith the use is not authorised, and that what you have told us is accurate.

We aim to acknowledge every notice within 2 business days and to act on a complete one within 5 business days. If a notice is incomplete we will say exactly what is missing rather than close it.

3. Artists: the short route

If you are the illustrator and you would simply rather your artwork was not sold here, you do not need any of the above. Email support@dakiheaven.com with Artist removal in the subject line, send us the link to the listing, and we will take it down.

We will not ask you to prove ownership of your own drawing, we will not ask you to justify the request, and we will not argue with you about it. This route exists because a takedown should not cost an independent artist a day of paperwork.

4. Artwork you send us

Our Custom Dakimakura service prints a file that you supply. We have never seen that file before you upload it and we cannot check who holds the rights in it, so that part is yours. When you place a custom order you confirm that:

  • You drew the artwork, or you have permission from whoever did.
  • The artwork does not sexualise anyone under 18, real or drawn.
  • The artwork does not depict a real, identifiable person in a sexual or intimate context without that person's consent.
  • You accept responsibility for any claim brought against us because of a file you supplied, including our reasonable costs in dealing with it.

You keep every right you already had in your artwork. You give us a limited permission to store, reproduce and print the file for the single purpose of producing your order. We do not add customer uploads to our catalogue, we do not sell them to anyone else, and we do not license them onward.

We may refuse or cancel any custom order, and refund it, without having to explain which of the points above we were unsure about. If we do and you believe we were mistaken, reply to us and we will look at it again.

5. What we do when a notice arrives

We acknowledge it. Where the notice is clear enough to act on, we remove or unpublish the listings it identifies while we review, because leaving a disputed design on sale during a review is the one outcome that helps nobody.

We keep a record of the notice, what we removed, and when. If we decide a notice was mistaken and we put something back, we will tell the person who sent it and say why.

6. Which law this runs under

Dakiheaven is established in the Netherlands. As set out in our Terms of Service, Dutch law governs our terms and the Dutch courts have exclusive jurisdiction, and we handle the notices described on this page under the European notice and action rules that apply to a business established in the EU.

We also accept notices written in the United States DMCA format, because many rights holders send them by default and we would rather read your notice than argue about its shape. Sending one does not move this dispute to United States law.
